Student Misconduct Policy

1. Purpose

This policy defines student misconduct and outlines the procedures for managing inappropriate, unsafe, dishonest, or disruptive behaviour that breaches Served to Cert’s standards.

2. Scope

This policy applies to all current and prospective students of Served to Cert Pty Ltd RTO ID 45605.

3. Definitions

Misconduct includes (but is not limited to):

  • Disruptive or disrespectful behaviour

  • Harassment, bullying or discrimination

  • Academic dishonesty (plagiarism, cheating)

  • Falsifying information during RPL or enrolment

  • Substance use during training activities

  • Breach of WHS procedures

  • Breach of privacy or confidentiality

  • Damage to RTO or third-party property

Serious Misconduct may include criminal activity, threats of violence, repeated breaches of conduct, or behaviour endangering others.

4. Misconduct Procedure

4.1 Informal Resolution

Where appropriate, minor misconduct will be addressed through:

  • Informal discussion with the student

  • Verbal warning or request to cease behaviour

  • Restorative conversations or mediation (if appropriate)

4.2 Formal Investigation

If misconduct is serious or repeated:

  1. A written notice will be issued outlining the alleged breach.

  2. The student will be given an opportunity to respond (in writing or verbally).

  3. An internal review will be conducted by a senior staff member or designated misconduct officer.

  4. An outcome will be determined based on evidence, fairness, and proportionality.

4.3 Outcomes

Possible outcomes may include:

  • Formal warning (recorded on student file)

  • Behavioural agreement

  • Suspension of access to services or training

  • Cancellation of enrolment

  • Referral to external authorities (if applicable)

5. Appeals

Students have the right to appeal any misconduct outcome under the Complaints and Appeals Policy, which ensures natural justice and procedural fairness.

6. Confidentiality

All misconduct matters will be handled in accordance with our Privacy Policy. Information will only be shared on a need-to-know basis.
